Acceptance of Terms

By submitting a vehicle for sale through Carnest, you confirm that you have read, understood, and agreed to these Terms & Conditions in their entirety. If you do not agree to these terms, please do not submit your vehicle listing.

These terms form a binding agreement between you (the seller) and Carnest. We reserve the right to update these terms at any time. Continued use of the service after changes are posted constitutes acceptance of the revised terms.

Commission Structure

A service commission of 3% of the agreed sale price applies to all successful vehicle sales facilitated through Carnest. This commission compensates Carnest for marketing, buyer sourcing, and transaction support services.

The commission is payable only upon a successful sale. If your vehicle does not sell, no commission will be charged. There are no upfront listing fees.

The commission is calculated on the actual agreed sale price at the time of sale, which may differ from the asking price you submitted in your request.

Valuation & Pricing

The expected price you submit in your sell request is your asking price and is not a guaranteed sale price. Carnest may provide a valuation assessment based on market conditions, vehicle condition, and comparable sales data.

We may facilitate negotiations between you and prospective buyers. The final agreed sale price is determined by mutual agreement between you and the buyer. Carnest does not guarantee that your vehicle will sell at your submitted asking price.

Our Role as Intermediary

Carnest acts solely as an intermediary and facilitator connecting vehicle sellers with prospective buyers. We are not the buyer of your vehicle, nor do we take ownership of the vehicle at any point in the process.

We are not responsible for the actions of buyers, nor do we guarantee that a buyer will be found for your vehicle. Our services include listing, marketing, and facilitating communication between parties.

Seller Responsibilities

As a seller, you warrant and represent that:

• You are the legal owner of the vehicle or have full authority to sell it on behalf of the owner.
• All information provided in your sell request (registration number, mileage, engine size, condition, etc.) is accurate and complete to the best of your knowledge.
• The vehicle is free from any undisclosed financial encumbrances, liens, or outstanding loans that would prevent or complicate the sale.
• You hold valid ownership documents (logbook) for the vehicle and will make them available upon request.
• Any known defects, accident history, or material issues with the vehicle have been disclosed.

You indemnify Carnest against any claims, losses, or damages arising from inaccurate information or failure to disclose material facts about the vehicle.

Payment Terms

Upon successful sale of your vehicle, the 3% commission on the agreed sale price becomes due immediately. Carnest will either:

• Deduct the commission from the sale proceeds before remitting the balance to you, or
• Invoice you directly for the commission amount, as mutually agreed.

No commission is charged for vehicles that do not sell. Any payment arrangement will be confirmed in writing before a sale is completed.

Cancellation & Withdrawal

You may withdraw your vehicle from sale at any time before a sale agreement is reached with a buyer, with no commission payable.

Once a sale has been agreed between you and a buyer (verbally or in writing), the 3% commission becomes due regardless of whether the transaction ultimately completes, unless the sale fails solely due to the buyer's default.
